Procedure for Consideration of Planning Applications

At the discretion of the Chairman, the following procedure will apply to the consideration of planning items:-

 

*           Planning Officer presents reports.

 

*           Comments invited from members of the public who have registered with the Governance Support Section (01279 446057) at least 24 hours in advance of the meeting, as follows:

 

-           3 (maximum) against an application.     

                        -           3 (maximum) for an application.

                        -           each speaker is limited to 3 minutes (maximum).

 

*           Comments invited from the applicant/agent for a maximum of 3 minutes (who has also given at least 24 hours notice to the Governance Support Section) of their wish to speak.

 

*           Councillors’ questions and clarifications.

 

*           Officers respond to the technical planning questions raised as directed by the Chairman.

 

*           Councillors debate and make a decision.

Minutes:

The Committee received a report on the planning application for the demolition of a two-bedroomed bungalow and construction of two four-bedroomed semi-detached houses with integral garages, four car spaces and full length rear gardens.

 

As there was the probability of bats in the area, it was agreed to include an additional informative clause regarding bats in the decision notice. 

 

RESOLVED that planning permission is GRANTED subject to the Conditions and Informative Clauses as detailed in the report plus the following additional Informative Clause:

 

3.         In Britain all species of bats are protested through their inclusion in Schedule 5 of the Wildlife and Countryside Act 1981 (as amended).  This makes it an offence under Section 9 of the Act to:

 

            (a)       intentionally kill, injure or take a bat;

 

            (b)       sell, hire, barter or exchange a bat dead or alive;

 

(c)        be in possession or control of a bat or anything derived from them;

 

(d)       disturb a bat; or

 

(e)       damage, destroy or block access to the resting place of any bat.

 

If at any time bats or evidence of bats are observed during tree work, operations should cease.

(b)       the Conditions and Informative Clauses as detailed in the report, subject to Condition 7 being amended to reference the tabled amended plans.
