Councillor Emma Toal declared a non-pecuniary interest in agenda item 8 (65 Fir Park) as she was acquainted with one of the objectors.  She did not participate in the consideration of this application nor vote.

Procedure for Consideration of Planning Applications

At the discretion of the Chair, the following procedure will apply to the consideration of planning items:-

 

*           Planning Officer presents reports.

 

*           Comments invited from members of the public who have registered with the Governance Support Section (01279 446057) at least 24 hours in advance of the meeting, as follows:

 

-           3 (maximum) against an application.      

                        -           3 (maximum) for an application.

                        -           each speaker is limited to 3 minutes (maximum).

 

*           Comments invited from the applicant/agent for a maximum of 3 minutes (who has also given at least 24 hours notice to the Governance Support Section) of their wish to speak.

 

*           Councillors’ questions and clarifications.

 

*           Officers respond to the technical planning questions raised as directed by the Chair.

 

*           Councillors debate and make a decision.

Minutes:

The Committee received a report on the planning application to modify the planning obligation to provide an off-site financial contribution in lieu of on-site affordable units.

 

Presentations were received from the agent and two objectors (including Councillor Joel Charles). 

 

Whilst it was acknowledged that a suitable site may not be found in Old Harlow, members of the Committee were keen to ensure that an exhaustive search in that location was undertaken initially.  To that end the recommendation proposed in the report was amended.

 

RESOLVED that the Section 106 Legal Agreement be modified as follows:

 

1.    The Section 106 Legal Agreement dated 26 April 2016 shall be varied to enable a financial contribution to be paid to Harlow District Council, to be used for the purposes of off-site provision of Affordable Housing, with the contribution being for use only within the Old Harlow Ward for the first two years and then anywhere in the district if the contribution were not used within that period.

Minutes:

The Committee received a report on the planning application for a change of use to a mother and baby assessment unit, offering parenting assessments by a registered social worker.

 

Presentations were received from the applicant and two objectors.

 

Due to concerns about disruption to local residents’ enjoyment of their properties (which had been raised by objectors), it was agreed that the unit’s operational management plan should include a record of complaints received from neighbours.  

 

RESOLVED that permission is GRANTED subject to the Conditions and Informative Clause as detailed in the report, subject to the substitution of the following revised wording for Condition 2:

 

2. Prior to the commencement of the proposed use, an operational management plan for the use shall be submitted to and approved in writing by the Local Planning Authority and the use shall at all times be operated in accordance with the agreed Plan.  This shall include, but not be limited to, staffing levels; times when residents may be permitted to leave the premises; times when the garden may be used; and CCTV supervision.  The Plan shall also include provisions for the submission of an annual log of complaints regarding the use to the Local Planning Authority.
