Minutes:

The Committee received its proposed work plan for the current municipal year.

 

Officers asked the Committee to note that its consideration of Public Space Protection Orders, scheduled for the 22 March 2015 meeting, would form part of a Council-wide policy development, as they are broader in scope than Designated Public Places Orders that the Committee has considered in the past, that deal only with consumption of alcohol in public places.

 

Officers agreed to explore whether any currently unallocated items could be programmed to specific Committee meetings in 2015/16, but asked the Committee to note that all of these items were dependent on information from external agencies such as the NHS, Gambling Commission etc.

 

Officers confirmed that Uber (a mobile phone-based car booking application) was not currently active in Harlow, but agreed to provide the Committee with an information report on Uber at the November 2015 meeting.

 

RESOLVED that:

 

A     A report on Uber will be received at the 17 November 2015 meeting of the Committee.

 

B    The Work Plan is noted, subject to A above.

The Committee received a report on the implementation of the Deregulation Act 2015. The 2015 Act amended the Local Government (Miscellaneous Provisions) Act 1976 to require that the Council  issue  driver and operator licences for three and five years respectively, or for a such lesser period as the Council thinks appropriate in the circumstances of the case.

 

The Chairman advised the Committee of a minor error on the report submitted. On Appendix 2, the ‘Refund for Surrender of Licence for 5 Year Operator Licence’ current wording of ‘2% for each unexpired full month’ should be replaced by ‘1.2% for each unexpired full month’.

 

The Committee also received a supplementary report which included responses of Hackney Carriage and Private Hire representatives arising from a consultation exercise. It welcomed a replacement Recommendation B in the supplementary report that addressed some of the concerns raised by trade representatives.

 

RESOLVED that:

 

A     The Committee notes the representations received in response to the consultation, as set out in the supplementary report.

 

B    The Committee RECOMMENDS to Council that the fees for three year Hackney Carriage and Private Hire drivers’ licences and renewals and five year Private Hire Operators’ licences and renewals as set out in Appendix 1 to the report submitted be adopted following the statutory notice procedure

 

C    All other proposed fee changes as set out in Appendix 1 to the report submitted are RECOMMENDED to Council to be adopted from 1 April 2016, following the statutory notice procedure.

 

D    It is RECOMMENDED to Council that the proposals on licences of shorter duration, record keeping for subcontracted bookings and on refunds, as set out at Appendix 2 to the report, be adopted as Council policy and to be licence conditions as appropriate.

 

E     It is RECOMMENDED to Council that the interim approach to licensing proposed at paragraph 14 of the report be adopted if required.
