Minutes:

The Committee received its proposed Work Plan for the current municipal year.

 

Officers asked the Committee to note that the unallocated items are awaiting guidance and/or legislation with the exception of Substantive Review of Gambling Act Licensing Policy Statement which would be considered by Officers and an update on when a revised policy is expected to be produced would be provided at the next meeting of the Committee.

 

RESOLVED that:

 

a)    the Work Plan is noted.

 

b)    an update on when a revised Gambling Act Licensing Policy Statement would be produced is to be provided at the January 2016 meeting of the Committee.

Statement of Gambling Policy - Outcome of Consultation pdf icon PDF 75 KB

The Committee received a report on the proposed Statement of Licensing Policy under Gambling Act 2005 which explained that following the report to Committee in July 2015 the Council had conducted a consultation.  The responses received require no amendments to the draft statement of Licensing Policy and it therefore recommended that the unchanged policy is re-adopted.

 

The Committee discussed possible gambling problems in Harlow and the people that gambling problems may affect currently and in the future.  Officers advised that the Council’s Scrutiny Committee had asked for a review of fixed odds betting terminals and that some of these issues would be considered as part of that review.

 

RESOLVED that:

 

a)    the Committee RECOMMENDS to Full Council adoption of the draft Statement of Licensing Policy, attached as Appendix 2 of the report.

 

b)    a future meeting of the Committee receive a report considering the implications for gambling licensing policy of revised Guidance to Local Authorities from the Gambling Commission.

The Committee received a report that detailed the Council’s statutory duty to enforce the Food Safety Act 1990.

 

The Committee discussed the Food Standards Agency national star rating scheme and possible ways to champion Harlow’s 5 star food establishments .  Officers confirmed that there currently is a link from the Council’s website to the national star rating scheme.

 

RESOLVED that the Food Safety Act 1990 Service Plan 2015/2016, attached as Appendix 1 of the report is approved.

The Committee received a report on the proposed private hire and hackney carriage fees following them being advertised in a local newspaper in accordance with statutory requirements and recommended no changes to its previous recommendation to Council on 24 September 2015.

 

A discussion was had regarding resources spent processing applications and how this is reflected in the charges.  

 

RESOLVED that:

 

a)    the Committee notes representations dated 9 October 2015 received from the Harlow Private Hire Committee, attached as Appendix A.

 

b)    the Committee agrees that the outcomes of the consultation requires no changes to its previous recommendation to Council, which was approved by Council on 24 September 2015.

The Committee received a report and briefing on UBER mobile device based private hire booking.

 

The Committee discussed issues concerning public safety and business operation.

 

RESOLVED that the Committee receive a further report if the Council receives a licensing application from Uber or a similar business.
