            RESOLVED that the procedure for the following hearings is noted.

Exclusion of Press and Public

The Chairman will move that the following items be taken in private session on the grounds that they are likely to involve the disclosure of exempt information as specified under Paragraph 1 of Part One of Schedule 12A of the Local Government Act 1972, if and so long as in all the circumstances of the case, the public interest in maintaining the exemption outweighs the public interest in disclosing information.

Determination for Grant of a Private Hire Driver Licence

The Sub-Committee received a report on an application for a private hire driver’s licence and considered all the evidence (including the tabled documents) to determine the case in accordance with the provisions of the Local Government (Miscellaneous Provisions) Act 1976.

 

RESOLVED that the applicant is deemed to be a ‘fit and proper’ person and be permitted to complete the remainder of the licensing process.

Review of Private Hire Driver Licence

The Sub-Committee received a report reviewing a private hire driver licenced by the Council.  All the evidence presented (including the tabled documents) was considered in accordance with the provisions of the Local Government (Miscellaneous Provisions) Act 1976 Section 61(b) and the Council’s Enforcement Policy.

 

RESOLVED that

 

(a)       a written warning be issued and advice given to provide the Licensing Team with monthly vehicle health check inspection reports (as issued by A G Autos) within 7 working days of their check, for the duration of the contract (12 months) with effect from 13 April 2017;

 

(b)       the licensed driver is informed that failure to comply with (a) above could result in further enforcement action being taken.
