Following a request from Essex Trading Standards (ETS), supported by Essex Police, the Sub-Committee received a report reviewing the premises licence issued to the Street Corner Shop.

 

The application for a review had been requested by ETS relating to the prevention of crime and disorder licensing objectives following the seizure of illegal cigarettes and hand rolling tobacco from the premises.

 

Members of the Sub-Committee considered the report and the evidence presented to the hearing by the licence holder’s legal representative; and representatives from ETS and Essex Police, to determine the case in accordance with the provisions of the Licensing Act 2003 S52.

 

In accordance with the procedure, Sub-Committee members, accompanied by the Committee Clerk, and Legal Advisors to the Sub-Committee, retired to discuss the evidence and representations.

 

The Sub-Committee reconvened in public session to give its decision, which would be confirmed in writing within five working days.

 

            RESOLVED that the licence be revoked.

 

 

(During consideration of this item, at 9.30pm the Sub-Committee agreed to continue the meeting until the completion of all the business on the agenda.)

The Chairman will move that the following item be taken in private session on the grounds that it is likely to involve the disclosure of exempt information as specified under Paragraph 1 of Part One of Schedule 12A of the Local Government Act 1972, if and so long as in all the circumstances of the case, the public interest in maintaining the exemption outweighs the public interest in disclosing information.

Following the deferment of this application at a previous meeting (Minute 21, 15/11/16 refers), the Sub-Committee convened to consider the case.

 

Members of the Sub-Committee received a report on the application for a private hire driver licence and considered all the evidence presented to determine the case in accordance with the provisions of the Local Government (Miscellaneous Provisions) Act 1976.

 

RESOLVED that the applicant is deemed to be a ‘fit and proper’ person and is therefore permitted to continue with the remainder of the licensing process for a private hire driver licence.
