RESOLVED that the procedure for the following hearing is noted.

 

(b)       Application for Renewal of Licence – William Aylmer Public House

 

The Sub-Committee received a report on an application to renew a licence for tables and chairs outside William Aylmer Public House.

 

Members of the Sub-Committee considered the report, which included objections to the proposal received from the Harlow Area Access Group (HAAG); and heard evidence presented by representatives of both the applicant and HAAG, before determining the application in accordance with the provisions of the Highways Act 1980.

 

In line with the procedure, the Sub-Committee members (accompanied by the committee clerk and the Sub-Committee’s legal advisor) considered the application in private.

 

The Sub-Committee reconvened in open session to give its decision on the application, which would be confirmed in writing within five working days.

 

RESOLVED that the application to renew the licence to place tables and chairs on the highway outside the premises known as William Aylmer Public House, Kitson Way, Harlow, Essex. CM20 1DG be approved subject to the following condition:

 

The applicant may place tables and chairs within the licensed area, only when suitable barriers are erected surrounding the boundary of that area.

The Chair will move that the following item be taken in private session on the grounds that it is likely to involve the disclosure of exempt information as specified under Paragraph 1 of Part One of Schedule 12A of the Local Government Act 1972, if and so long as in all the circumstances of the case, the public interest in maintaining the exemption outweighs the public interest in disclosing information.

Determination of Application for Private Hire Driver Licence

RESOLVED that the procedure for the following hearing is noted.

 

(b)       Determination of Application for a Private Hire Driver Licence

 

The Sub-Committee received a report on an application for a private hire driver’s licence, which had previously been put on hold pending the outcome of Court proceedings (Minute 9, 20/6/17 refers.)

 

Although the outcome was not yet known, as the Court proceedings had been postponed to January 2018, the applicant had requested that the application be considered by a Licensing Sub-Committee.

 

The Sub-Committee considered the application to determine the case in accordance with the provisions of the Local Government (Miscellaneous Provisions) Act 1976.

 

Having carefully considered all the evidence presented by the officer from the Licensing Department, the applicant and the applicant’s representative, it was:

 

RESOLVED that the applicant is deemed not to be a ‘fit and proper’ person and is therefore not permitted to continue with the application process for a driver’s licence.
