The Sub-Committee received a report on the application for a premises licence for the Marquis of Granby Public House in Old Harlow, which included extended opening hours and live music.


Members of the Sub-Committee considered the information contained in the report, together with tabled photographs supplied by an objector, a tabled copy of the Harlow Council Statement of Licensing Policy and presentations given by the applicant (accompanied by her son), three objectors and the Licensing Officer, to determine the case in accordance with the provisions and licensing objectives of the Licensing Act 2003.


Members of the Sub-Committee noted the operational changes and concessions regarding the opening hours, which the applicant had offered up since the report had been published.  They also noted the conditions which the Police and the Council’s Environmental Health Team had requested to be imposed.


In line with the procedure, the Sub-Committee members retired to consider the case, accompanied by the Committee Clerk and the Sub-Committee’s Legal Advisor.  Whilst in this private session, members of the Sub-Committee voted to continue the meeting beyond 9.30pm in order to complete the remaining business on the agenda (Standing Order 9).


The Sub-Committee reconvened in public session to deliver its decision.


RESOLVED that the premises licence be granted subject to:


a)    the following conditions (which includes those offered up by the applicant at the meeting):


i)    Opening hours:        Sun-Thurs     11am-11pm.

             Fri & Sat         11am-midnight.


ii)  Supply of alcohol     Sun-Thurs     11am-10.30pm.

 Fri & Sat         11am-11.30pm.


iii)  Live music to terminate by 10.30pm on Friday and Saturday and 10pm on Sunday.


iv)  No recorded music after 11.30pm on Friday and Saturday.


v)    Plastic glasses only on Friday and Saturday evenings.


vi)  No glass bottles and only plastic glasses to be taken outside.


vii) Installation of HD CCTV.


viii)                Two licensed door supervisors (one inside, one outside) to be on duty from 8pm until 15 minutes after the premises are closed.


ix)  No doors to be wedged open.


x)    Installation of a sound limiter.


xi)  The back wall to be soundproofed.


xii) The conditions agreed with the Police (page 84 of the agenda).


b)    As the Sub-Committee is not satisfied that the conditions to prevent public nuisance recommended by Environmental Health (page 88 of the agenda) are enforceable; an assessment be undertaken of the sound insulation and appropriate improvement works be carried out so as to ensure that sound generated from within the sensitive premises to the satisfaction of the Council’s Environmental Health Officer.


c)    A sound-limiting device to be installed and set to a level agreed with the licensing authority subject to the assessment.            


d)    A condition that windows and doors of the property to remain closed after 8pm.


e)    Local residents be advised of the protection available to them under the Environmental Protection Act.
