RESOLVED that Councillor Frances Mason is elected to chair this hearing.

The Chair will move that the following item be taken in private session on the grounds that it is likely to involve the disclosure of exempt information as specified under Paragraph 1 of Part One of Schedule 12A of the Local Government Act 1972, if and so long as in all the circumstances of the case, the public interest in maintaining the exemption outweighs the public interest in disclosing information.

Summary Review - Full Summary Review Hearing

Minutes:

On 5 December 2019, the Council received an application for Summary Review of the premises licence in respect of The Willow, Hodings Road, Harlow, CM20 1NN made by Essex Police (applicant).

 

On 6 December 2019, the Council determined to take interim steps to suspend the premises licence until a full review hearing.

 

Representation against the interim steps were received from the Licence Holder and a hearing to consider the representations was held on 11 December 2019. At this meeting, the Council determined to lift the suspension from Friday 20 December 2019 and attach conditions to the licence.

 

At this full hearing, Members of the Sub Committee considered the request made to review the premises licence and decided whether the interim steps in place should be withdrawn or modified.

 

Having carefully considered all the evidence presented by the Licensing Officer, Essex Police (applicant), two representatives, the Licence Holder and the Licence Holder’s representative it was:

 

RESOLVED that the interim steps agreed on 11 December 2019 to be modified and replaced with agreed conditions determined by the Licensing Sub Committee as well as those submitted by the Premises Licence Holder and agreed with Essex Police subject to changes made by the Licensing Sub Committee as set out in the decision notice dated 2 January 2020. A copy of the signed decision notice would be provided upon request.
