To appoint a Chair for this meeting.  

RESOLVED that Councillor Nick Churchill was elected as Chair for the meeting. 

Councillors’ declarations of interest (if any) in relation to any items on the

agenda.

None.

The Chair will move that the following item be taken in private session on

the grounds that it is likely to involve the disclosure of exempt information

as specified under Paragraph 1 of Part One of Schedule 12A of the Local

Government Act 1972, if and so long as in all the circumstances of the

case, the public interest in maintaining the exemption outweighs the

public interest in disclosing information.

Paragraph 1: Information relating to any individual.

RESOLVED that the following items be taken in private session on the grounds that they are likely to involve the disclosure of exempt information as specified under Paragraph 1 of Part One of Schedule 12A of the Local Government Act 1972, if and so long as in all the circumstances of the case, the public interest in maintaining the exemption outweighs the public interest in disclosing information.

RESOLVED that the procedure for the meeting has been noted.

The Sub Committee received a report on a review of the retention of a Private Hire Drivers Licence (currently suspended).

Members of the Sub Committee considered all the information and evidence presented to determine the case in accordance with the provisions of the Local Government (Miscellaneous Provisions) Act 1976, the General Enforcement Policy for Hackney Carriage and Private Hire Licensing v6 and the Institute of Licensing’s ‘Guidance for determining the suitability of applicants and licensees in the hackney and private hire trades’ (as adopted 1 October 2019).

Having carefully considered all of the information presented by the Licensing Officer, the applicant and the applicant’s witnesses it was:

RESOLVED that the applicant is deemed to be a ‘fit and proper’ person and is permitted to retain a Private Hire Drivers Licence. The licence suspension will be lifted.
